Terms of Service

Welcome to Sail Robin ("Sail Robin", "we", "our", or "us"), operated by JoDaPaMa Marine LTD. By using the Sail Robin app, you ("user" or "you") agree to these Terms of Service. Please read them carefully, as they constitute a legally binding agreement.

1. Acceptance of Terms

By creating an account or using our app, you confirm that you have read, understood, and agree to these Terms of Service ("Terms") and our Privacy Policy. If you disagree with any part of the Terms, please discontinue use.

2. Eligibility

You must be at least 16 years old to create an account and use Sail Robin. If you are between 13 and 15 years of age, you may only use the app with the consent and supervision of a parent or legal guardian. In such cases, the parent or guardian accepts these Terms on behalf of the minor and takes responsibility for the minor's use of the app, including any data collected and compliance with these Terms.

3. Description of Service

Sail Robin is a sailing race tracking and tactical navigation application. The app provides GPS-based course card navigation for sailing, race recording, performance analytics, social features including public race sharing, and related sailing tools. Sail Robin is designed to assist with tactical race navigation — helping sailors navigate between racing marks based on club course cards. It is not a coastal or chart navigation system and does not provide information on water depths, rocks, shipping lanes, tidal streams, or other hazards. It is not a substitute for proper seamanship, certified marine navigation equipment, or good judgment on the water.

4. Account Creation and Responsibilities

Account Setup: You agree to provide accurate, current, and complete information when creating an account.

Security: You are responsible for maintaining the security of the email account used to sign in. Sail Robin uses email-based authentication (magic links) — you agree to notify us immediately of any unauthorised account use.

User Conduct: You agree to use Sail Robin responsibly and only for lawful purposes. Misuse of features or violation of these Terms may lead to account suspension or termination.

5. Data Collection and Privacy

Data Usage: By using Sail Robin, you consent to the collection and use of performance data, GPS data, and profile information for the purposes of providing our services, analysis, and app improvement. Full details are set out in our Privacy Policy.

Location Data: Sail Robin collects GPS and location data to provide course navigation, race tracking, and performance analytics. This data may be collected while the app is running in the background during active sailing sessions. You can control location permissions through your device settings.

Privacy Policy: Please refer to our Privacy Policy for full details on data collection, processing, retention, and your rights under the General Data Protection Regulation (GDPR). Your data is treated with strict confidentiality and in compliance with applicable data protection laws.

6. User-Generated Content

Data Ownership: You retain ownership of any sailing data, race recordings, and performance metrics you generate. However, by uploading data or making races public, you grant Sail Robin a non-exclusive, worldwide, royalty-free licence to display, analyse, store, and anonymise such data to enhance the user experience, provide leaderboards, and improve app functionality.

Public Sharing: When you make a race public, it may appear on leaderboards, in other users' feeds, and in club rankings. You can change the visibility of your races at any time from your profile.

Prohibited Content: You agree not to upload content that is inappropriate, offensive, defamatory, or that violates any applicable laws.

7. Subscriptions and Payments

Merchant of Record: Sail Robin subscriptions are sold through our authorised reseller, Paddle.com Market Ltd (for purchases outside the United States) or Paddle.com Inc (for purchases within the United States). Paddle acts as the Merchant of Record for all subscription transactions. By purchasing a subscription, you agree to Paddle's Terms of Use and Privacy Policy in addition to these Terms.

Free and Premium Features: Sail Robin offers both free features and premium subscription options. Certain features, including Performance Analytics (Robin Flight School), Race Course Navigation, and external device connectivity, require an active subscription.

Subscription Plans: Sail Robin offers time-based subscription passes (Regatta Pass, Season Pass, and Annual Pass). Each pass activates from the moment of purchase and provides access for its stated duration. Subscription fees are as stated at the time of purchase and may change from time to time. Prices include applicable taxes.

Payment Processing: All payments are processed securely by Paddle. We do not store your payment details. You agree to receipt of all invoices and receipts in electronic format. Paddle will charge your chosen payment method for any paid transactions, including any applicable taxes.

Free Trial: New users receive a free 30-day trial with full access to all premium features. No credit card is required for the trial. If you do not purchase a subscription before the trial expires, premium features will be disabled and you will continue to have access to all free features.

8. Cancellation and Refund Policy

Consumer Right to Cancel: If you are a consumer, you have the right to cancel your subscription within 14 days of purchase without giving any reason, provided you have not yet accessed or used the premium features. To exercise this right, contact us at info@sailrobin.com before the expiration of the 14-day period.

Refunds: Beyond the 14-day consumer cancellation period, refunds are provided at the sole discretion of Paddle on a case-by-case basis. Paddle may refuse a refund request if there is evidence of fraud, refund abuse, or other manipulative behaviour. This does not affect your statutory rights as a consumer in relation to products which are not as described, faulty, or not fit for purpose.

No Refunds on Unused Periods: There are no refunds for unused portions of a subscription pass. If you choose not to use Sail Robin during your subscription period, you are not entitled to a partial refund.

Effect of Cancellation: If your cancellation or refund request is approved, Paddle will reimburse all payments received from you without undue delay, and not later than 14 days after the day on which the cancellation is confirmed. The reimbursement will be made using the same means of payment as the original transaction.

How to Request a Refund: To request a refund or cancellation, contact us at info@sailrobin.com with your order number and the email address used to make the purchase.

9. Intellectual Property

Sail Robin Content: All features, designs, user interface, data analytics tools, branding, and the compilation and presentation of course databases and mark coordinate data within the app are owned by or licensed to JoDaPaMa Marine LTD. While individual course and mark data may originate from publicly available sources, the specific compilation, organisation, formatting, and integration of this data within Sail Robin represents significant effort and is protected as our intellectual property. Users may not copy, extract, modify, distribute, or reverse-engineer these resources without written permission.

User Rights: You are granted a limited, non-exclusive, revocable right to access and use the app and your own data and insights within it. You may not extract or reproduce Sail Robin's analytics, course data, or club databases for commercial gain.

10. Sailing Safety and Limitation of Liability

No Warranty of Accuracy: While Sail Robin strives to provide accurate GPS data, course card information, mark positions, and weather data, no guarantees are made regarding the precision or reliability of this information. GPS accuracy may be affected by device hardware, atmospheric conditions, obstructions, and other factors beyond our control. Mark positions and course data are compiled from publicly available sources and may contain errors.

User Responsibility: You are solely responsible for your safety while sailing. You must carry appropriate charts, safety equipment, and navigation instruments as required by maritime regulations. Sail Robin does not replace proper seamanship, situational awareness, knowledge of local waters, or compliance with the International Regulations for Preventing Collisions at Sea (COLREGS).

Liability Waiver: To the fullest extent permitted by law, Sail Robin and JoDaPaMa Marine LTD are not responsible for any accidents, damages, injuries, loss, or death occurring while you use the app during sailing or any other activities. Use of Sail Robin is entirely at your own risk.

Service Availability: We do not guarantee uninterrupted access to Sail Robin. The app may be temporarily unavailable due to maintenance, updates, or factors outside our control. We are not liable for any loss arising from service interruptions.

11. Account Termination

Sail Robin reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activities, or misuse app features. You may delete your account at any time through the app settings. Account deletion is subject to a 30-day grace period as described in our Privacy Policy.

12. Third-Party Services

Sail Robin uses third-party services to operate, including but not limited to database hosting, authentication, payment processing, email communications, and weather data providers. We are not responsible for the availability or accuracy of third-party services. Your use of Sail Robin constitutes acceptance of the relevant terms and privacy policies of these providers.

13. Modifications to Terms

Sail Robin may modify these Terms from time to time. We will notify you of significant changes through the app or by email. Continued use of the app after changes have been communicated indicates acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use and delete your account.

14. Governing Law

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or app use will be subject to the exclusive jurisdiction of the courts of Ireland.
