Terms of Service

Welcome to Sail Robin ("Sail Robin", "we", "our", or "us"), operated by JoDaPaMa Marine LTD. By using the Sail Robin app, you ("user" or "you") agree to these Terms of Service. Please read them carefully, as they constitute a legally binding agreement.

1. Acceptance of Terms

By creating an account or using our app, you confirm that you have read, understood, and agree to these Terms of Service ("Terms") and our Privacy Policy. If you disagree with any part of the Terms, please discontinue use.

2. Eligibility

You must be 16 or over to create a Sail Robin account. By creating an account you confirm that you meet this requirement. An adult may create an account on behalf of a junior sailor — for example, a parent or coach setting up an account for use by a junior competitor. The account holder is responsible for all use of the account and compliance with these Terms.

3. Description of Service

Sail Robin is a sailing race tracking and tactical navigation application. The app provides GPS-based course card navigation for sailing, race recording, performance analytics, social features including public race sharing, and related sailing tools. Sail Robin is designed to assist with tactical race navigation — helping sailors navigate between racing marks based on club course cards. It is not a coastal or chart navigation system and does not provide information on water depths, rocks, shipping lanes, tidal streams, or other hazards. It is not a substitute for proper seamanship, certified marine navigation equipment, or good judgment on the water.

4. Account Creation and Responsibilities

Account Setup: You agree to provide accurate, current, and complete information when creating an account.

Security: You are responsible for maintaining the security of the email account used to sign in. Sail Robin uses email-based authentication (magic links) — you agree to notify us immediately of any unauthorised account use.

User Conduct: You agree to use Sail Robin responsibly and only for lawful purposes. Misuse of features or violation of these Terms may lead to account suspension or termination.

Username Policy: You agree to choose a username that is not offensive, obscene, hateful, or discriminatory. You may not impersonate another person, sailing club, organisation, or brand. Sail Robin reserves the right to require you to change a username that violates this policy or to suspend accounts where impersonation causes harm or confusion.

5. Data Collection and Privacy

Data Usage: By using Sail Robin, you consent to the collection and use of performance data, GPS data, and profile information for the purposes of providing our services, analysis, and app improvement. Full details are set out in our Privacy Policy.

Location Data: Sail Robin collects GPS and location data to provide course navigation, race tracking, and performance analytics. This data may be collected while the app is running in the background during active sailing sessions. You can control location permissions through your device settings.

Privacy Policy: Please refer to our Privacy Policy for full details on data collection, processing, retention, and your rights under the General Data Protection Regulation (GDPR). Your data is treated with strict confidentiality and in compliance with applicable data protection laws.

AI Training and Anonymised Statistics: Race and performance data may also be used, in anonymised and aggregated form, to train and improve Sail Robin's AI-powered features (including the Robin performance assistant), and to produce anonymised sailing statistics. Data used for these purposes will be stripped of personally identifiable information before use. We may in future provide controls allowing you to opt out of your data being used for AI training purposes; any such controls will be communicated through the app or our Privacy Policy.

6. User-Generated Content

Data Ownership: You retain ownership of any sailing data, race recordings, and performance metrics you generate. However, by uploading data or making races public, you grant Sail Robin a non-exclusive, worldwide, royalty-free licence to display, analyse, store, and anonymise such data to enhance the user experience, provide leaderboards, and improve app functionality.

Public Sharing: When you make a race public, it may appear on leaderboards, in other users' feeds, and in club rankings. You can change the visibility of your races at any time from your profile.

Prohibited Content: You agree not to upload content that is inappropriate, offensive, defamatory, or that violates any applicable laws.

Fair Usage: Sail Robin is designed for individual sailors tracking their own racing activity. Accounts used for bulk or commercial data aggregation — including uploading race data on behalf of multiple third parties, automated data extraction, or any use that places disproportionate load on our infrastructure — are not permitted under a standard user account and require a separate commercial arrangement. Sail Robin reserves the right to limit, throttle, or suspend accounts that exceed reasonable individual usage without prior notice.

7. Subscriptions and Payments

Free and Premium Features: Sail Robin offers both free features and premium subscription options. Certain features, including Performance Analytics (Robin Flight School), Race Course Navigation, and external device connectivity, require an active subscription.

Subscription Plans: Sail Robin offers time-based subscription passes (Regatta Pass, Season Pass, and Annual Pass). Each pass activates from the moment of purchase and provides access for its stated duration. Subscription fees are as stated at the time of purchase and may change from time to time. Prices include applicable taxes.

Free Trial: New users receive a free 30-day trial with full access to all premium features. No credit card is required for the trial. If you do not purchase a subscription before the trial expires, premium features will be disabled and you will continue to have access to all free features.

Payment via Web (Paddle): Subscriptions purchased via the Sail Robin website are sold through our authorised reseller, Paddle.com Market Ltd (for purchases outside the United States) or Paddle.com Inc (for purchases within the United States). Paddle acts as the Merchant of Record for these transactions. By purchasing via the web, you agree to Paddle's Terms of Use and Privacy Policy in addition to these Terms. We do not store your payment details — Paddle handles all payment information securely.

Payment via iOS (Apple App Store): Subscriptions purchased through the Apple App Store are processed by Apple. Your purchase is subject to Apple's Media Services Terms and Conditions. We do not store your payment details — Apple handles all payment information securely.

Payment via Android (Google Play): Subscriptions purchased through Google Play are processed by Google. Your purchase is subject to Google Play's Terms of Service. We do not store your payment details — Google handles all payment information securely.

Subscription Portability: Your subscription is linked to your Sail Robin account, not to a specific device or platform. An active subscription purchased on any platform grants access to premium features across all platforms where you are signed in to the same account.

8. Cancellation and Refund Policy

Purchases via Web (Paddle): If you are a consumer who purchased via the Sail Robin website, you have the right to cancel your subscription within 14 days of purchase without giving any reason, provided you have not yet accessed or used the premium features. To exercise this right, contact us at info@sailrobin.com before the expiration of the 14-day period.

Beyond the 14-day consumer cancellation period, web refunds are provided at the sole discretion of Paddle on a case-by-case basis. Paddle may refuse a refund request if there is evidence of fraud, refund abuse, or other manipulative behaviour. This does not affect your statutory rights as a consumer in relation to products which are not as described, faulty, or not fit for purpose.

Purchases via Apple App Store: If you purchased a subscription through the Apple App Store, cancellations and refunds are handled directly by Apple in accordance with Apple's own terms and policies. Sail Robin has no ability to issue refunds for App Store purchases. To request a refund, visit reportaproblem.apple.com.

Purchases via Google Play: If you purchased a subscription through Google Play, cancellations and refunds are handled directly by Google in accordance with Google Play's refund policies. Sail Robin has no ability to issue refunds for Google Play purchases. To request a refund, visit the Google Play subscriptions page.

No Refunds on Unused Periods: There are no refunds for unused portions of a subscription pass regardless of the purchase platform. If you choose not to use Sail Robin during your subscription period, you are not entitled to a partial refund.

Effect of Cancellation (Web/Paddle): If your cancellation or refund request via Paddle is approved, Paddle will reimburse all payments received from you without undue delay, and not later than 14 days after the day on which the cancellation is confirmed, using the same means of payment as the original transaction.

How to Request a Refund (Web): To request a refund or cancellation for a web purchase, contact us at info@sailrobin.com with your order number and the email address used to make the purchase.

9. Intellectual Property

Sail Robin Content: All features, designs, user interface, data analytics tools, branding, and the compilation and presentation of course databases and mark coordinate data within the app are owned by or licensed to JoDaPaMa Marine LTD. While individual course and mark data may originate from publicly available sources, the specific compilation, organisation, formatting, and integration of this data within Sail Robin represents significant effort and is protected as our intellectual property. Users may not copy, extract, modify, distribute, or reverse-engineer these resources without written permission.

User Rights: You are granted a limited, non-exclusive, revocable right to access and use the app and your own data and insights within it. You may not extract or reproduce Sail Robin's analytics, course data, or club databases for commercial gain.

10. Sailing Safety and Limitation of Liability

No Warranty of Accuracy: While Sail Robin strives to provide accurate GPS data, course card information, mark positions, and weather data, no guarantees are made regarding the precision or reliability of this information. GPS accuracy may be affected by device hardware, atmospheric conditions, obstructions, and other factors beyond our control. Mark positions and course data are compiled from publicly available sources and may contain errors.

User Responsibility: You are solely responsible for your safety while sailing. You must carry appropriate charts, safety equipment, and navigation instruments as required by maritime regulations. Sail Robin does not replace proper seamanship, situational awareness, knowledge of local waters, or compliance with the International Regulations for Preventing Collisions at Sea (COLREGS).

Liability Waiver: To the fullest extent permitted by law, Sail Robin and JoDaPaMa Marine LTD are not responsible for any accidents, damages, injuries, loss, or death occurring while you use the app during sailing or any other activities. Use of Sail Robin is entirely at your own risk.

Service Availability: We do not guarantee uninterrupted access to Sail Robin. The app may be temporarily unavailable due to maintenance, updates, or factors outside our control. We are not liable for any loss arising from service interruptions.

11. Account Termination

Sail Robin reserves the right to suspend or terminate accounts at any time, with or without notice, where we reasonably believe that a user has violated these Terms, engaged in fraudulent or abusive behaviour, misused app features, or where continued access would be detrimental to other users or to the service. This includes but is not limited to: impersonation, offensive usernames, bulk or commercial misuse of the platform, harassment of other users, or any conduct that Sail Robin, in its sole discretion, considers inappropriate. You may delete your account at any time through the app settings. Account deletion is subject to a 30-day grace period as described in our Privacy Policy.

12. Third-Party Services

Sail Robin uses third-party services to operate, including but not limited to database hosting, authentication, payment processing, email communications, and weather data providers. We are not responsible for the availability or accuracy of third-party services. Your use of Sail Robin constitutes acceptance of the relevant terms and privacy policies of these providers.

13. Modifications to Terms

Sail Robin may modify these Terms from time to time. We will notify you of significant changes through the app or by email. Continued use of the app after changes have been communicated indicates acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use and delete your account.

14. Governing Law

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or app use will be subject to the exclusive jurisdiction of the courts of Ireland.
